The New York State Bar Association concluded that lawyers could use gmail and comply with the duty of confidentiality despite the fact that email is ’scanned’ by Google to place contextual ads. The committee warned that this sort of unthinking, automated review was proper, but not human review. N.Y. St. B. Ass’n. Comm. Prof. Eth. Op. 820 (Feb. 8, 2008).

In Formal Opinion 2008-1 (July 2008), the Committee on Professional and Judicial Ethics of the Association of the Bar of the City of New York addressed various issues concerning the organization, delivery, and the ability to charge clients for delivery of electronic files after the end of a representation. A national lawyer association ethically may place its membership directory on its Internet web site, categorized by practice areas. See Arizona Opinion 99-10 (September 1999). The association may want to: 1) list State Bar admissions for each member, to avoid unauthorized practice of law concerns; and 2) clarify that the ?practice area? designations do not necessarily mean that the lawyers are certified specialists in those fields.

It is proper for an Ohio lawyer to be listed in the online membership directory of a professional association. Opinion 99-3 (June 4, 1999). An online membership directory of attorneys in a professional association is considered a law directory intended primarily for the use of the legal profession and is permitted. The opinion notes that it should not be construed as blanket approval of attorney listings in other types of online directories.
